I recognize and acknowledge that participation in activities at the Dyersville Family Aquatic Center involves inherent risks, including but not limited to drowning, near drowning, slipping or falling on wet surfaces, diving-related injuries, collisions with other patrons, sun exposure, exposure to waterborne illnesses, pool equipment, and recreational water activities. I am fully aware of the risks and hazards involved, and I am willing to assume these risks on behalf of myself and my accompanying parties.

I agree to comply with all rules imposed by Dyersville Events, Inc. and the Dyersville Family Aquatic Center regarding the use of the facilities and equipment. I agree to always conduct myself in a controlled and reasonable manner and to refrain from doing anything inconsistent with the intended design and purpose of the facilities or equipment.

I acknowledge that swimming and water-related activities require varying levels of skill and physical ability. I accept responsibility for determining whether I and my accompanying parties possess the necessary swimming abilities to participate safely in aquatic activities, and I understand that participation should be limited to activities appropriate to each individual’s abilities. I understand and acknowledge that at times no lifeguard may be on duty. During such times, swimming and participation in aquatic activities are entirely at my own risk and the risk of any accompanying parties. I accept full responsibility for my own safety and for the safety and supervision of any minors in my care.

I understand that children who cannot swim independently or who require flotation assistance must be under the direct supervision of a responsible parent, guardian, or designated adult at all times while within the aquatic facility.

I do hereby waive, release, discharge, and agree to indemnify Dyersville Events, Inc., the Dyersville Family Aquatic Center, their employees, officers, contractors, and representatives, and all sponsors and their employees, officers, contractors, and representatives (the “Released Parties”), from any and all loss, damage, and/or expense of any nature whatsoever, including all attorneys’ fees and costs, arising directly or indirectly from my participation or the participation of my accompanying parties in the Program (including but not limited to traveling to or from the Program). I understand that the claims I am forever releasing and waiving include, but are not limited to, claims for all known or unknown personal injury or property loss or damage, and all known or unknown damages associated with any illness or sickness that I or my accompanying parties may contract, arising out of or in connection with the Program.

I hereby certify that I and my accompanying parties as necessary have and will maintain medical, full property insurance including, but not limited to physical damage, bodily injury, and liability in the event of an incident. If I or my accompanying parties do not have health or property insurance, I hereby understand that I or my accompanying parties will be responsible for all medical, property replacements, and other associated costs associated with participation in the Program. I agree not to participate in aquatic activities if I or any accompanying party has a known medical condition, illness, injury, or impairment that could create an unsafe condition for us or others.

I agree to comply with all posted pool rules, safety signage, and instructions provided by facility staff. Unsafe, reckless, or disruptive behavior may result in removal from the facility without a refund.

If any sentence or paragraph of this Agreement is held invalid, it is agreed that the balance thereof shall continue in full legal force and effect.

I do hereby authorize Dyersville Events, Inc. to email or mail information to all addresses and email addresses provided to Dyersville Events, Inc.

If any dispute arises out of the terms and conditions of this Agreement, or another Dyersville Events, Inc. program, I hereby agree that Dubuque County, Iowa (or, if the case is brought in federal court, the U.S. District Court for the District of Northern Iowa, Cedar Rapids Division) shall be the exclusive jurisdiction for resolution of any and all disputes and that Iowa law shall be applied to any action brought in state or federal court.

If executed by electronic signature, any persons executing this document are expressly consenting under the Electronic Signatures in Global and National Commerce Act ("E-SIGN"), and Uniform Electronic Transactions Act ("UETA"), that a signature by fax, email or other electronic means shall constitute an Electronic Signature to an Electronic Record under both E-SIGN and UETA with respect to this Agreement. Licensee (i) intends to be bound by such signatures on any document sent or delivered by facsimile or, electronic mail, or other electronic means, (ii) is aware that the other party will rely on such signatures, and (iii) hereby waives any defenses to the enforcement of the terms of this Agreement based on the foregoing forms of signature.

By signing, I agree to the above waiver and release of claims and join therein. I understand that participation in the Program is entirely voluntary, without duress or coercion. In the event of an emergency, I grant to Dyersville Events, Inc., Dyersville Family Aquatic Center, and their officers, employees, and representatives full authority to take whatever action they may consider appropriate under the circumstances involved regarding the health and safety of myself and any accompanying party members, and I authorize them to obtain emergency medical or dental services for myself or accompanying party member, if necessary, at my expense.
